1. Acceptance & Legal Entity

By accessing [thecivilcompany.in], its mobile applications, or AI tools, you agree to be bound by these Terms. The Civil Company is a brand owned and operated by Swarnam Info Hub Private Limited. These terms constitute a legally binding agreement between you and the Company.

2. Nature of the Platform (Intermediary Status)

The Civil Company is an "Intermediary" under the Information Technology Act, 2000. We provide a digital discovery and visualization ecosystem. We do not provide construction, execution, or architectural services. We do not employ, supervise, or control the professionals listed. Any engagement is strictly a private contract between the User and the Professional.

3. Spacebot AI & Spacelist (Conceptual Use & Licensing)

• Not for Construction: AI-generated outputs are conceptual visualizations only. They are not architectural drawings, structural plans, or execution-ready designs. All measurements and safety checks must be validated by a licensed professional.
• Automatic Publication: By using Spacebot AI, the User grants the Company a perpetual, royalty-free, worldwide license to automatically upload and display generated designs in the Spacelist gallery for public inspiration and AI training.
• User Responsibility: It is the User's responsibility to ensure that any base photos uploaded to Spacebot AI do not violate third-party privacy or intellectual property rights.

4. "Verified" Badge & WhatsApp Authentication

Documents collected for the "Verified" badge (like Aadhaar) are:

• Verification Process: A "Verified" badge indicates that the Company has:
  • 1.Collected a Government ID (Aadhaar/PAN) for record purposes.
  • 2. Obtained explicit written confirmation via WhatsApp from the professional’s registered mobile number.
• Digital Contract: A professional’s reply of "I AGREE" (or similar affirmative response) to the Company's official WhatsApp verification script constitutes a digital acceptance of these Terms.
• No Guarantee: "Verified" status strictly confirms identity documentation availability. It does not imply a criminal background check, behavioral assessment, or a guarantee of skill, quality, or financial credibility.

5. Virtual Numbers & Privacy Masking

To protect privacy and maintain platform integrity, we use masked virtual numbers for communication.

• Monitoring: Communication via these numbers may be logged for security, quality, and dispute resolution purposes.
• No Liability: The Company is not responsible for the content of conversations, verbal commitments, or the outcome of any agreement reached via these masked channels.

6. Payments & Professional Listings

Professionals may pay for "Verified" badges or enhanced visibility.

• Billing Entity: All payments are made to Swarnam Info Hub Private Limited.
• Refunds: Payments for verification or digital services are non-refundable once the verification process has commenced.

7. Intellectual Property (IP)

All platform content, including the brand name "The Civil Company," logos, Spacebot AI algorithms, and the Spacelist database, are the exclusive property of Swarnam Info Hub Private Limited. Unauthorized commercial reproduction is strictly prohibited.

8. Limitation of Liability (The "Shield" Clause)

To the maximum extent permitted by Indian law, the Company shall not be liable for construction defects, financial loss, or misconduct by third-party professionals.

• Liability Cap: The Company’s total liability for any claim shall not exceed the amount paid by the User to the Platform in the last six (6) months. If no payment was made, the Company’s liability is zero.

9. Service Availability & Maintenance

The Company strives to keep the platform accessible 24/7; however, we do not guarantee uninterrupted service. The platform may be unavailable due to scheduled maintenance or Force Majeure events (e.g., internet outages, government bans). The Company is not liable for any "loss of business" or "lost leads" during periods of downtime.

10. Termination & Revocation of Status

The Company reserves the right to suspend or terminate a User’s account or revoke a "Verified" badge without prior notice if:

• The User provides fraudulent documentation or misrepresents their identity on WhatsApp.
• The User misuses AI tools or violates third-party IP rights.
• The Company receives valid, repeated complaints regarding the professional's conduct. Termination does not entitle the User to a refund of previously paid fees.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from the use of this platform shall be subject to the exclusive jurisdiction of the Courts of Delhi, India.
